Museum of Illusions – Terms & Conditions

§ 1. General Infomation

1. The Museum of Illusions (hereinafter referred to as the “Museum”) is managed by the company Muzeum Świat Iluzji sp. z o.o., sp.k. with its registered office in Warsaw at Rynek Starego Miasta 21, 00-273 Warsaw, entered into the National Court Register under KRS number 0001130575, REGON: 366932467, NIP: 1132936609, with a share capital of PLN 5,000.00;

Hereinafter referred to as the “Organizer” or “Museum”.

2. The Museum is located at Rynek Starego Miasta 19/21, 00-273 Warsaw.

3. These Regulations (hereinafter referred to as the “Regulations”) were issued by the Organizer pursuant to the provisions of the Act of April 23, 1964, Civil Code (consolidated text: Dz. U. 2023, item 1610 as amended), the Act of May 30, 2014, on consumer rights (consolidated text: Dz. U. 2023, item 2759 as amended), and other applicable laws that have a direct impact on the organization or operation of the
Museum.

4. The Regulations apply to all persons on the Museum’s premises during its opening hours, individuals purchasing entrance tickets, and those contacting the Organizer in any form.

§ 2. Access to Museum Exhibits

1. The Museum is open to visitors on days and hours determined by the Organizer, according to the information available at the Museum’s ticket office and on its website and social media.

2. Entrance to the Museum exhibits is paid. The ticket price list is available at the Museum ticket office and on the Museum’s website.

3. For safety reasons, the number of people allowed in the Museum building is limited.

§ 3. Types of Tickets

§ 4. Ticket Office, Ticket Purchase in the Office and Online

1. Admission tickets to the Museum are available at the Museum ticket office and for online purchase through the Museum’s website at: https://swiatiluzji.pl.

2. The Museum’s ticket office sells tickets for the day of purchase, except for vouchers, which, once prepaid at the Museum ticket office, entitle the holder to visit the Museum on a different day, as long as the voucher’s validity period, indicated on the voucher, has not expired.

3. A ticket is a document, either in printed form or as a readable PDF file displayed on a mobile device screen, confirming the right to visit the Museum for a specified number of people on a specific date, for which payment has been made.

Types of tickets:
A. Regular ticket – valid only on the day specified on the ticket.
B. Voucher – valid for a day other than the purchase date, until the voucher’s expiration date, provided it was prepaid at the Museum ticket office.

4. The Organizer reserves the right to stop ticket sales and suspend admission to the Museum when the maximum number of visitors in the Museum has been reached. This applies to all types of tickets, including tickets purchased for a specific time through the Museum’s website.

5. The ticket buyer is required to retain the receipt, invoice, bank transfer confirmation, or any other document confirming the purchase until leaving the Museum premises.

6. The Museum ticket office accepts payment in Polish zlotys (PLN) in cash and via payment cards, provided the payment systems are operational.

7. If no ticket is issued, a fiscal receipt for the ticket purchase serves as the entry authorization.

8. Tickets may only be sold at the prices set by the Organizer in the Ticket Price List. Resale of tickets at any price other than the one specified in the Price List, including at auctions, contests, promotional campaigns, lotteries, or for commercial resale outside the Museum ticket office and online through the Museum’s website, is prohibited.

9. The visitor is responsible for sharing the ticket with third parties. If several people present the same ticket at the Museum, only the first person to use the ticket will be admitted.

10. The Museum’s ticket office sells tickets up to 60 minutes before closing time.

11. Ticket offices may, but are not obligated to, accept payments in other currencies at an exchange rate set by the Museum.

12. No refunds are provided for unused tickets, except in cases where the ticket could not be used due to reasons attributable to the Organizer.

13. Tickets are also available for purchase online directly through the Museum’s website. Detailed terms of purchase are set out in the online ticket sales regulations available on the Museum’s website.

14. Tickets remain the property of the Organizer until the Organizer receives confirmation of payment from the visitor’s bank or until cash payment is made.

15. The Organizer is not responsible for the operation of the Internet network through which tickets are purchased.

16. Admission with an online ticket is only possible after presenting the ticket in digital form or as a printed ticket so that the Organizer’s staff can verify the purchase in the online ticket verification system.

17. Group ticket sales are handled via direct contact at the Museum ticket office, by email at kontakt@swiatiluzji.pl, or by phone at +48 501 808 006.

18. Tickets purchased through intermediaries are subject to the refund policies of those platforms. The Organizer is not responsible for transactions made through intermediary websites.

§ 5. Provisions Concerning Organized Groups

1. For groups larger than 10 people, prior reservation of the visit is required to gain entry to the Museum.

2. Group tickets are not available for online purchase, as organized group entry requires prior arrangement and confirmation of the visit date with Museum ticket office staff.

3. Every organized group of minors must be accompanied by at least one adult guardian.

4. In the case of kindergarten and school groups, one guardian is required for every 15 children.

5. If the group is more than 15 minutes late, Museum staff may refuse to allow the group to visit the first part of the exhibition with a guide. In such cases, the group visit will proceed independently from the beginning.

6. The guide/guardian is responsible for maintaining discipline among the group.

7. Specifically, the duties of the guide/guardian include:
A. Before entering the exhibition: explaining the rules (e.g., turning off or silencing mobile phones, prohibiting phone conversations, not touching the exhibits, etc.);
B. Ensuring that the group follows only designated paths and complies with the instructions and comments of the Organizer’s staff during the tour;
C. Intervening in cases of inappropriate behavior by the individuals in their care;
D. The guide/guardian must not violate the established order of the tour, scheduled entry times, or access hours to the Museum’s exhibitions.

8. The guide and their group must not:
A. Block the sightseeing routes, entrances to particular rooms, or emergency exits;
B. Hinder or obstruct individual visitors or members of other organized groups.

§ 6. Rules for Visitors on Museum Premises

1. The ticket grants a single entry to the exhibitions only. Exiting the exhibition area (passing through the gates) signifies the end of the visit.

2. The visit is self-guided. The Organizer does not provide guides.

3. External guides are not allowed to operate on the Museum premises without the Organizer’s permission.

4. Children under the age of 13 must be accompanied by an adult responsible for the child.

5. The parents or guardians are responsible for the safety of children during the visit. They are required to instruct their children on the rules of the Museum and ensure their safety while touring. Parents or guardians are legally liable for any damages caused by their children to persons or property.

6. The Organizer reserves the right to restrict access to any part of the Museum for visitors.

7. Information regarding restricted access, where possible, and if it concerns more than 20% of the exhibits, will be communicated to visitors before purchasing a ticket, either at the Museum ticket office, on the Museum’s website (www.swiatiluzji.pl / https://swiatiluzji.pl/en/home/ ), or through the Museum’s social media
profiles (Facebook and Instagram).

8. The Museum reserves the right to exclude exhibits that have become faulty, damaged, or destroyed. Information regarding restricted access will be provided, where possible, if it concerns more than 20% of the exhibits.

9. Restricting access to parts of the Museum or excluding some exhibits does not constitute grounds for a refund, in whole or in part, of the ticket price.

10. During the visit, visitors must follow the instructions and recommendations of the Organizer’s staff or other persons designated by the Organizer.

11. Exhibits should be used according to the instructions provided on plaques near the attractions, instructions given by the Organizer’s staff, or other persons designated by the Organizer, and visitors should pay attention to warnings and communications.

12. The Organizer is not responsible for any incidents resulting from failure to follow instructions or improper use of the exhibits.

13. Any malfunctions, damage, or destruction of Museum property should be immediately reported to the Organizer’s staff or other persons designated by the Organizer.

14. Eating and drinking are not allowed on the Museum premises.

15. The Organizer is not responsible for items left unattended in the Museum.

16. The Museum provides a free cloakroom, which visitors use at their own risk. Large bags, backpacks, suitcases, umbrellas, Nordic walking poles, etc., must be left outside the exhibition area.

§ 7. Prohibitions

1. Visitors on Museum premises are prohibited from engaging in any behavior that could endanger others or Museum property. In particular, visitors are prohibited from:
A. Removing any Museum property from its premises;
B. Moving any Museum property outside its designated location;
C. Damaging any Museum property;
D. Bringing animals into the Museum, except for guide dogs and assistance dogs;
E. Bringing and consuming alcohol, or smoking tobacco;
F. Bringing and using narcotics;
G. Bringing and using electronic cigarettes;
H. Bringing weapons, explosives, or other items dangerous to life and health, including lasers;
I. Bringing and using bicycles, scooters, skateboards, or other similar devices, and riding them;
J. Conducting commercial activities;
K. Engaging in advertising or political campaigning;
L. Acting in a vulgar or aggressive manner towards others;
M. Running, jumping, or sliding on floors, inclines, and steep surfaces;
N. Eating and drinking;
O. Using mobile phones for conversations;
P. Behaving loudly or disturbing the peace of other visitors;
Q. Creating dangerous situations;
R. Taking photographs or recording with additional lighting, tripods, or other accessories necessary for professional photography or filming, except in cases where the Organizer has given prior written consent for such sessions.

2. People under the influence of alcohol or drugs, as well as individuals behaving in a manner that endangers the safety of visitors or exhibits, disrupts order, or violates commonly accepted norms of behavior in public places, are prohibited from being on the Museum premises.

3. Individuals violating these prohibitions will be asked to leave the Museum. In such cases, no refund for the ticket will be given.

§ 8. Specific Rules for Particular Attractions

1. Visitors must familiarize themselves with the operating instructions for each exhibit.

2. Visitors must use each exhibit in accordance with the operating instructions or information boards placed next to the exhibits and pay attention to warnings and messages displayed near the exhibits.

§ 9. Returns

1. Ticket returns are not possible, except for group tickets. Group ticket returns can be made if the return request is submitted 7 days before the scheduled visit date. Partial returns of group tickets are possible provided that the remaining number of tickets in the reservation is no less than 10.

2. In exceptional cases of unforeseen circumstances, it is possible to reschedule a visit for another date by contacting the Organizer’s staff via email.

§ 10. Safety

1. The Museum is under video surveillance and is protected by employees of a specialized security company.

2. The purposes of video surveillance are:
A. To increase the safety of people on the Museum premises and protect the exhibits;
B. To safeguard property from theft and vandalism;
C. To protect against actions that may cause damage to the Organizer.

3. In case of a security threat, the Organizer reserves the right to stop ticket sales and is authorized to demand that individuals creating the threat leave the Museum premises.

4. In the event of a threat to the health or life of visitors, the Organizer reserves the right to immediately suspend the tour of the exhibits.

5. If an evacuation order is announced, all individuals on the Museum premises are required to immediately leave the building through the nearest emergency exit and strictly follow the instructions of the Organizer’s employees and Museum security personnel.

6. Evacuation does not constitute grounds for a refund of the ticket price, either in whole or in part.

7. The Organizer does not provide a cloakroom for deposit.

8. The Organizer ensures fire safety in accordance with applicable legal regulations.

§ 11. Complaints Procedure

1. Only visitors are entitled to file complaints under these Regulations.

2. All complaints should be submitted via email to the Organizer’s email address: kontakt@swiatiuzji.pl or in writing to the Organizer’s address [Warsaw 00-273, Rynek Starego Miasta 21], with the note “complaint”.

3. Complaints will be reviewed by the Organizer within 14 (fourteen) days from the date of their submission. The date of submission is considered to be the date the complaint is delivered to the Organizer.

4. The Organizer reserves the right to store copies of correspondence with the visitor.

5. If the complaint is resolved in the visitor’s favor, the Organizer will immediately rectify the issue. This does not affect the visitor’s ability to make a statement regarding price reduction or withdrawal from the contract in accordance with applicable law.

6. The visitor has the right to pursue claims not acknowledged during the complaint process in a competent court of law.

§ 12. Personal Data Protection

1. ADMINISTRATOR – The personal data administrator is the Museum.

2. DATA PROTECTION OFFICER – For matters related to the processing and protection of personal data, you can contact the Data Protection Officer appointed by the administrator via email at: kontakt@swiatiluzji.pl or in writing at the administrator’s registered office address: Muzeum.

3. SOURCE OF DATA – The administrator processes data from individuals who have filled out the Order Form in the Module. If a ticket was sent to a person who did not place an order via the Order Module, their data was provided by the person filling out the Order Form. Personal data obtained through the completion of the above-mentioned Form includes the following categories: first name, last name, email address. Optionally, phone number and language version of the Module. To obtain a VAT invoice, the address and NIP (Tax Identification Number) are also collected.

4. PURPOSE OF PROCESSING – Personal data of those ordering tickets for museum exhibitions or participating in events organized at the Museum through the Module will be processed for the following purposes:
A. To provide electronic services by entering into sales agreements for tickets ordered through the Module, and executing those agreements, as well as registering accounts for placing further orders through the Module for ticket sales on the website (Article 6(1)(b) of GDPR);
B. To process ticket refunds and handle complaints (Article 6(1)(b) of GDPR);
C. To fulfill legal obligations, particularly those related to financial reporting (Article 6(1)(c) of GDPR);
D. To pursue the legitimate interests of the administrator (Article 6(1)(f) of GDPR), which include:
• Conducting marketing activities via newsletters—these activities, sent via email or phone, are subject to separate consent for using the appropriate communication channels;
• Responding to inquiries sent by those ordering via email or telephone;
• Establishing, pursuing, or defending claims related to the operation of the Module and services provided through it.

5. DATA RETENTION PERIOD – Personal data will be processed for the following durations:
A. For the duration of the sales agreement between the data subject and the administrator, and after its termination, until the expiration of any claims arising from it;
B. For data processed within the framework of the legitimate interest of the administrator, until a legitimate objection is raised by the data subject, subject to the next point;
C. For marketing activities, until consent for sending such information electronically or by phone is withdrawn, or until an objection to such processing is raised, whichever occurs first;
D. Until the expiration of the legal obligation to retain the data, particularly in relation to storing financial documents related to the sales agreement.

6. DATA RECIPIENTS – Personal data may be shared with:
A. State authorities and other entities authorized by law to access the data, to the extent and for the purposes defined by applicable laws;
B. External entities providing services supporting the administrator’s operations, including transport companies, IT service providers, auditing entities, entities responsible for electronic payments, and entities enabling the operation of the Museum.

7. RIGHTS OF DATA SUBJECTS – In connection with the processing of personal data, the individuals using the service have the following rights, in cases provided for by law:
A. The right to access their personal data;
B. The right to rectify their personal data;
C. The right to erase their personal data;
D. The right to restrict the processing of their personal data;
E. The right to data portability;
F. The right to object to the processing of their personal data;
G. The right to withdraw consent for the processing of personal data if such consent was the legal basis for processing, without affecting the lawfulness of processing carried out prior to the withdrawal;
H. The right to file a complaint with the supervisory authority, i.e., the President of the Personal Data Protection Office. 8. VOLUNTARY PROVISION OF PERSONAL DATA – The provision of personal data by individuals placing orders is voluntary; however, failure to provide the necessary data (as specified in the Order Form) will prevent or hinder the provision of services by the administrator, including the ability to purchase tickets online.

9. TRANSFER OF DATA TO THIRD COUNTRIES – Personal data of individuals purchasing tickets online through the Module will not be transferred to countries outside the European Economic Area.

10. AUTOMATED PROCESSING, INCLUDING PROFILING – The administrator will not engage in automated processing (including profiling) of the personal data of those ordering tickets, which could have legal effects on them or significantly affect them in any other way.

§ 13. GDPR Information Clause for ONLINE TICKET SALES FOR MUSEUM EXHIBITIONS In accordance with Article 13 of the General Data Protection Regulation (GDPR) of April 27, 2016 (EU) 2016/679, we inform you that:
1. The personal data administrator for the Module is the Museum.
2. For matters related to the processing and protection of personal data, you can contact the Data Protection Officer appointed by the administrator via email at kontakt@swiatiluzji.pl or in writing at the administrator’s registered office: Muzeum.
3. The administrator processes the personal data of individuals who filled out the Order Form in the Module. If a ticket was sent to a person who did not place an order, the data was provided by the individual who filled out the Order Form.

§ 13. GDPR Information Clause for ONLINE TICKET SALES FOR MUSEUM EXHIBITIONS

1. The personal data obtained from the Order Form includes the following categories: first name, last name, email address. Optionally, phone number and the language version of the Module. In the case of requesting a VAT invoice, the following information is also collected: address and NIP (Tax Identification Number).
2. Purposes of Data Processing – Personal data of individuals ordering tickets to visit the Museum exhibitions or participate in events organized by the Museum through the Module will be processed for the following purposes:
A. To provide electronic services by entering into sales agreements for tickets ordered by the customer through the Module and executing those agreements, as well as to register accounts for placing future orders through the ticket sales Module on the website (Article 6(1)(b) GDPR);
B. To process ticket returns and address any complaints (Article 6(1)(b) GDPR);
C. To fulfill legal obligations, particularly related to financial reporting (Article 6(1)(c) GDPR);
D. To pursue the legitimate interests of the administrator (Article 6(1)(f) GDPR), which includes:
• Conducting marketing activities through newsletters – subject to separate consent, email or phone-based marketing will only be performed with the appropriate communication channel approval;
• Responding to inquiries sent by individuals ordering tickets via email or phone;
• Establishing, pursuing, or defending claims related to the operation of the Module and services provided through it.

3. Data Retention Period – Personal data will be processed:
A. For the duration of the sales agreement between the customer and the administrator, and after its termination, until the expiration of any claims arising from it;
B. For data processed in the pursuit of the legitimate interests of the administrator, until a legitimate objection is raised by the customer, subject to the next point;
C. For marketing activities, until consent for electronic or phone-based marketing is withdrawn or an objection is raised, whichever comes first;
D. Until the expiration of the legal obligation to retain data, particularly the obligation to retain financial documents related to the sales agreement.

4. Recipients of Data – Personal data may be shared with:
A. Government authorities and other entities authorized by law to access the data to the extent and for the purposes defined by law;
B. External entities providing services that support the administrator’s operations, such as transport companies, IT service providers, auditing entities, payment processors, and entities responsible for enabling the Museum’s operations.

5. Rights of Data Subjects – In relation to the processing of personal data, individuals ordering tickets via the service have the following rights, as specified by law:
A. The right to access their personal data;
B. The right to rectify their personal data;
C. The right to delete their personal data;
D. The right to restrict the processing of their personal data;
E. The right to data portability;
F. The right to object to the processing of their personal data;
G. The right to withdraw consent for processing personal data if consent was the legal basis for processing, without affecting the lawfulness of the processing carried out prior to the withdrawal;
H. The right to file a complaint with the supervisory authority, i.e., the President of the Personal Data Protection Office – more information about this right is available at: https://uodo.gov.pl/pl/p/skargi. 6. Voluntary Provision of Data – Providing personal data by individuals placing orders is voluntary; however, failure to provide the necessary data (as indicated in the Order Form) will prevent or hinder the provision of services by the administrator, including the ability to purchase tickets online.

7. Transfer of Data to Third Countries – Personal data of individuals ordering tickets online through the Module will not be transferred to countries outside the European Economic Area.

8. Automated Processing, Including Profiling – The administrator will not engage in automated processing (including profiling) of personal data of individuals ordering tickets, which would result in legal effects or significantly affect them in any other way.

§ 14. Final Provisions

1. Visitors are required to follow the instructions given by Museum staff, including instructions on matters not specifically covered in the Regulations.

2. The Regulations are available on the Museum’s website and at the Museum ticket office.

3. In the event of any discrepancies arising from the translation into a foreign language, the Polish version of the regulations shall prevail.
